nahrazuj\u00ed dosavadn\u00ed \u00d6HVB ve zn\u011bn\u00ed ze dne 23. z\u00e1\u0159\u00ed 1981.<br>1.2 VOPH 2006 nevylu\u010duj\u00ed zvl\u00e1\u0161tn\u00ed ujedn\u00e1n\u00ed. VOPH 2006<br>jsou subsidi\u00e1rn\u00ed v\u016f\u010di individu\u00e1ln\u011b sjednan\u00fdm dohod\u00e1m.<br>\u00a7 2 Definice pojm\u016f<br>2.1 Definice pojm\u016f:<br>\u201eUbytovatel\u201c: Je fyzick\u00e1 nebo pr\u00e1vnick\u00e1 osoba, kter\u00e1 za \u00faplatu ubytov\u00e1v\u00e1 hosty.<br>\u201eHost\u201c: Je fyzick\u00e1 osoba, kter\u00e1 vyu\u017e\u00edv\u00e1 ubytov\u00e1n\u00ed. Host je zpravidla sou\u010dasn\u011b smluvn\u00edm partnerem. Za hosty se pova\u017euj\u00ed i osoby, kter\u00e9 p\u0159ij\u00ed\u017ed\u011bj\u00ed se smluvn\u00edm partnerem (nap\u0159. rodinn\u00ed p\u0159\u00edslu\u0161n\u00edci, p\u0159\u00e1tel\u00e9 atd.).<br>\u201eSmluvn\u00ed partner\u201c: Je tuzemsk\u00e1 nebo zahrani\u010dn\u00ed fyzick\u00e1 nebo pr\u00e1vnick\u00e1 osoba, kter\u00e1 jako<br>host nebo pro hosta uzav\u00edr\u00e1 smlouvu o ubytov\u00e1n\u00ed. \u201eSpot\u0159ebitel\u201c a \u201epodnikatel\u201c: Tyto pojmy je t\u0159eba ch\u00e1pat ve smyslu z\u00e1kona o ochran\u011b spot\u0159ebitele z roku 1979 v platn\u00e9m zn\u011bn\u00ed.<br>\u201eSmlouva o ubytov\u00e1n\u00ed\u201c: Je smlouva uzav\u0159en\u00e1 mezi ubytovatelem a smluvn\u00edm partnerem, jej\u00ed\u017e obsah je d\u00e1le podrobn\u011bji upraven.<br>\u00a7 3 Uzav\u0159en\u00ed smlouvy \u2013 z\u00e1loha<br>3.1 Smlouva o ubytov\u00e1n\u00ed vznik\u00e1 p\u0159ijet\u00edm objedn\u00e1vky smluvn\u00edho partnera ubytovatelem. Elektronick\u00e1 prohl\u00e1\u0161en\u00ed se pova\u017euj\u00ed za doru\u010den\u00e1, pokud k nim strana, kter\u00e9 jsou ur\u010dena, m\u00e1 za obvykl\u00fdch okolnost\u00ed p\u0159\u00edstup a doru\u010den\u00ed prob\u011bhne v ozn\u00e1men\u00e9 provozn\u00ed dob\u011b ubytovatele.<br>3.2 Ubytovatel je opr\u00e1vn\u011bn uzav\u0159\u00edt smlouvu o ubytov\u00e1n\u00ed pod podm\u00ednkou, \u017ee smluvn\u00ed partner zaplat\u00ed z\u00e1lohu. V takov\u00e9m p\u0159\u00edpad\u011b je ubytovatel povinen p\u0159ed p\u0159ijet\u00edm p\u00edsemn\u00e9 nebo \u00fastn\u00ed objedn\u00e1vky smluvn\u00edho partnera na po\u017eadovanou z\u00e1lohu upozornit. Pokud smluvn\u00ed partner se z\u00e1lohou souhlas\u00ed (p\u00edsemn\u011b nebo \u00fastn\u011b), vznik\u00e1 smlouva o ubytov\u00e1n\u00ed doru\u010den\u00edm souhlasn\u00e9ho prohl\u00e1\u0161en\u00ed o zaplacen\u00ed z\u00e1lohy smluvn\u00edho partnera ubytovateli.<br>3.3 Smluvn\u00ed partner je povinen zaplatit z\u00e1lohu nejpozd\u011bji do 3 dn\u016f (p\u0159ips\u00e1n\u00ed na \u00fa\u010det) po p\u00edsemn\u00e9 nebo \u00fastn\u00ed objedn\u00e1vce. N\u00e1klady na pen\u011b\u017en\u00ed transakci (nap\u0159. poplatky za p\u0159evod) nese smluvn\u00ed partner. Pro kreditn\u00ed a debetn\u00ed karty plat\u00ed p\u0159\u00edslu\u0161n\u00e9 podm\u00ednky kartov\u00fdch spole\u010dnost\u00ed.<br>3.4 Z\u00e1loha je \u010d\u00e1ste\u010dnou platbou na sjednanou odm\u011bnu.<br>\u00a7 4 Za\u010d\u00e1tek a konec ubytov\u00e1n\u00ed<br>4.1 Smluvn\u00ed partner m\u00e1 pr\u00e1vo, pokud ubytovatel nenab\u00eddne jin\u00fd \u010das, nast\u011bhovat se do pronajat\u00fdch prostor od 15:00 hodin sjednan\u00e9ho dne (\u201eden p\u0159\u00edjezdu\u201c).<br>4.2 Pokud je pokoj vyu\u017eit poprv\u00e9 p\u0159ed 6:00 hodinou rann\u00ed, po\u010d\u00edt\u00e1 se p\u0159edchoz\u00ed noc jako prvn\u00ed p\u0159enocov\u00e1n\u00ed.<br>4.3 Pronajat\u00e9 prostory mus\u00ed smluvn\u00ed partner v den odjezdu uvolnit do 10:00 hodin.           Ubytovatel je opr\u00e1vn\u011bn \u00fa\u010dtovat dal\u0161\u00ed den, pokud pronajat\u00e9 prostory nejsou uvoln\u011bny v\u010das.<br>\u00a7 5 Odstoupen\u00ed od smlouvy o ubytov\u00e1n\u00ed \u2013 storno poplatek<br>Odstoupen\u00ed ubytovatelem<br>5.1 Pokud smlouva o ubytov\u00e1n\u00ed p\u0159edpokl\u00e1d\u00e1 z\u00e1lohu a z\u00e1loha nebyla smluvn\u00edm partnerem zaplacena v\u010das, m\u016f\u017ee ubytovatel od smlouvy o ubytov\u00e1n\u00ed odstoupit bez poskytnut\u00ed dodate\u010dn\u00e9 lh\u016fty.<br>5.2 Pokud se host nedostav\u00ed do 18:00 hodin sjednan\u00e9ho dne p\u0159\u00edjezdu, nevznik\u00e1 povinnost ubytov\u00e1n\u00ed, leda\u017ee byl sjedn\u00e1n pozd\u011bj\u0161\u00ed \u010das p\u0159\u00edjezdu.<br>5.3 Pokud smluvn\u00ed partner zaplatil z\u00e1lohu (viz 3.3), z\u016fst\u00e1vaj\u00ed prostory rezervov\u00e1ny nejpozd\u011bji do 12:00 hodin dne n\u00e1sleduj\u00edc\u00edho po sjednan\u00e9m dni p\u0159\u00edjezdu. P\u0159i platb\u011b p\u0159edem na v\u00edce ne\u017e \u010dty\u0159i dny kon\u010d\u00ed povinnost ubytov\u00e1n\u00ed od 18:00 hodin \u010dtvrt\u00e9ho dne, p\u0159i\u010dem\u017e den p\u0159\u00edjezdu se po\u010d\u00edt\u00e1 jako prvn\u00ed den, leda\u017ee host ozn\u00e1m\u00ed pozd\u011bj\u0161\u00ed den p\u0159\u00edjezdu.<br>5.4 Nejpozd\u011bji 14 dn\u00ed p\u0159ed sjednan\u00fdm dnem p\u0159\u00edjezdu smluvn\u00edho partnera m\u016f\u017ee b\u00fdt smlouva o ubytov\u00e1n\u00ed ubytovatelem z v\u011bcn\u011b od\u016fvodn\u011bn\u00fdch d\u016fvod\u016f, leda\u017ee bylo dohodnuto jinak, jednostrann\u00fdm prohl\u00e1\u0161en\u00edm zru\u0161ena.<br>Odstoupen\u00ed smluvn\u00edm partnerem \u2013 storno poplatek<br>5.5 Nejpozd\u011bji 14 dn\u00ed p\u0159ed sjednan\u00fdm dnem p\u0159\u00edjezdu hosta m\u016f\u017ee b\u00fdt smlouva o ubytov\u00e1n\u00ed bez zaplacen\u00ed storno poplatku jednostrann\u00fdm prohl\u00e1\u0161en\u00edm smluvn\u00edho partnera zru\u0161ena. <\/p><p>5.6 Mimo obdob\u00ed stanoven\u00e9 v \u00a7 5.5 je odstoupen\u00ed jednostrann\u00fdm prohl\u00e1\u0161en\u00edm smluvn\u00edho partnera mo\u017en\u00e9 pouze p\u0159i zaplacen\u00ed n\u00e1sleduj\u00edc\u00edch storno poplatk\u016f: <\/p><p>do 14 dn\u016f: \u017e\u00e1dn\u00e9 storno poplatky<br>v posledn\u00edch 14 dnech: 100 %<\/p><p>P\u0159ek\u00e1\u017eky p\u0159i p\u0159\u00edjezdu<br>5.7 Pokud se smluvn\u00ed partner nem\u016f\u017ee v den p\u0159\u00edjezdu dostavit do ubytovac\u00edho za\u0159\u00edzen\u00ed, proto\u017ee v d\u016fsledku nep\u0159edv\u00eddateln\u00fdch mimo\u0159\u00e1dn\u00fdch okolnost\u00ed (nap\u0159. extr\u00e9mn\u00ed sn\u011b\u017een\u00ed, povodn\u011b atd.) jsou ve\u0161ker\u00e9 mo\u017enosti p\u0159\u00edjezdu nemo\u017en\u00e9, nen\u00ed smluvn\u00ed partner povinen platit sjednanou odm\u011bnu za dny p\u0159\u00edjezdu.<br>5.8 Povinnost zaplatit odm\u011bnu za rezervovan\u00fd pobyt se obnovuje od okam\u017eiku, kdy je p\u0159\u00edjezd op\u011bt mo\u017en\u00fd, pokud se tak stane b\u011bhem t\u0159\u00ed dn\u016f.<br>\u00a7 6 Pr\u00e1va smluvn\u00edho partnera<br>6.1 Uzav\u0159en\u00edm smlouvy o ubytov\u00e1n\u00ed z\u00edsk\u00e1v\u00e1 smluvn\u00ed partner pr\u00e1vo na obvykl\u00e9 u\u017e\u00edv\u00e1n\u00ed pronajat\u00fdch prostor, za\u0159\u00edzen\u00ed ubytovac\u00edho za\u0159\u00edzen\u00ed, kter\u00e1 jsou host\u016fm b\u011b\u017en\u011b a bez zvl\u00e1\u0161tn\u00edch podm\u00ednek p\u0159\u00edstupn\u00e1 k u\u017e\u00edv\u00e1n\u00ed, a na obvyklou obsluhu.<br>Smluvn\u00ed partner mus\u00ed sv\u00e1 pr\u00e1va vykon\u00e1vat v souladu s p\u0159\u00edpadn\u00fdmi hotelov\u00fdmi a\/nebo n\u00e1v\u0161t\u011bvn\u00edmi \u0159\u00e1dy (domovn\u00ed \u0159\u00e1d).<br>Domovn\u00ed \u0159\u00e1d Wolf &amp; Schaf Apartments, zna\u010dka spole\u010dnosti Nomad at Home GmbH, Ried 149, 5360 St. Wolfgang im Salzkammergut<br>1. \u017d\u00e1dn\u00e9 ve\u010d\u00edrky<br>2. \u017d\u00e1dn\u00e1 dom\u00e1c\u00ed zv\u00ed\u0159ata<br>3. Vyhrazujeme si pr\u00e1vo \u00fa\u010dtovat poplatky uveden\u00e9 ve VOP v p\u0159\u00edpad\u011b jejich nedodr\u017een\u00ed.   <\/p><p>\u00a7 7 Povinnosti smluvn\u00edho partnera<br>7.1 Smluvn\u00ed partner je povinen nejpozd\u011bji v okam\u017eiku odjezdu zaplatit sjednanou odm\u011bnu plus p\u0159\u00edpadn\u00e9 dal\u0161\u00ed \u010d\u00e1stky, kter\u00e9 vznikly na z\u00e1klad\u011b zvl\u00e1\u0161tn\u00edho vyu\u017eit\u00ed slu\u017eeb j\u00edm a\/nebo hosty, kte\u0159\u00ed ho doprov\u00e1zej\u00ed, plus z\u00e1konnou da\u0148 z p\u0159idan\u00e9 hodnoty.<br>7.2 Ubytovatel nen\u00ed povinen p\u0159ij\u00edmat ciz\u00ed m\u011bny. Pokud ubytovatel ciz\u00ed m\u011bny p\u0159ij\u00edm\u00e1, jsou tyto br\u00e1ny k \u00fahrad\u011b podle mo\u017enost\u00ed v denn\u00edm kurzu. Pokud by ubytovatel p\u0159ij\u00edmal ciz\u00ed m\u011bny nebo bezhotovostn\u00ed platebn\u00ed prost\u0159edky, nese smluvn\u00ed partner ve\u0161ker\u00e9 souvisej\u00edc\u00ed n\u00e1klady, jako jsou dotazy u spole\u010dnost\u00ed vyd\u00e1vaj\u00edc\u00edch kreditn\u00ed karty, telegramy atd.  <br>7.3 Smluvn\u00ed partner odpov\u00edd\u00e1 ubytovateli za ka\u017edou \u0161kodu, kterou zp\u016fsob\u00ed on nebo host nebo jin\u00e9 osoby, kter\u00e9 s v\u011bdom\u00edm nebo v\u016fl\u00ed smluvn\u00edho partnera p\u0159ij\u00edmaj\u00ed slu\u017eby ubytovatele.<br>\u00a7 8 Pr\u00e1va ubytovatele<br>8.1 Pokud smluvn\u00ed partner odm\u00edtne zaplatit sjednanou odm\u011bnu nebo je s n\u00ed v prodlen\u00ed, n\u00e1le\u017e\u00ed ubytovateli z\u00e1konn\u00e9 zadr\u017eovac\u00ed pr\u00e1vo podle \u00a7 970c ABGB a z\u00e1konn\u00e9 z\u00e1stavn\u00ed pr\u00e1vo podle \u00a7 1101 ABGB k v\u011bcem vnesen\u00fdm smluvn\u00edm partnerem, resp. hostem.<br>Toto zadr\u017eovac\u00ed nebo z\u00e1stavn\u00ed pr\u00e1vo n\u00e1le\u017e\u00ed ubytovateli d\u00e1le k zaji\u0161t\u011bn\u00ed jeho pohled\u00e1vky ze smlouvy o ubytov\u00e1n\u00ed, zejm\u00e9na za stravov\u00e1n\u00ed, ostatn\u00ed v\u00fddaje vynalo\u017een\u00e9 za smluvn\u00edho partnera a za p\u0159\u00edpadn\u00e9 n\u00e1roky na n\u00e1hradu jak\u00e9hokoli druhu.<br>8.2 Pokud je vy\u017eadov\u00e1n servis na pokoji smluvn\u00edho partnera nebo v neobvyklou denn\u00ed dobu (po 19:00 hodin\u011b a p\u0159ed 7:00 hodinou), je ubytovatel opr\u00e1vn\u011bn za to po\u017eadovat zvl\u00e1\u0161tn\u00ed p\u0159\u00edplatek. Tento zvl\u00e1\u0161tn\u00ed p\u0159\u00edplatek v\u0161ak mus\u00ed b\u00fdt vyzna\u010den v cen\u00edku pokoj\u016f. Ubytovatel m\u016f\u017ee tyto slu\u017eby z provozn\u00edch d\u016fvod\u016f tak\u00e9 odm\u00edtnout.<br>8.3 Ubytovatel m\u00e1 pr\u00e1vo na vy\u00fa\u010dtov\u00e1n\u00ed, resp. pr\u016fb\u011b\u017en\u00e9 vy\u00fa\u010dtov\u00e1n\u00ed sv\u00fdch slu\u017eeb kdykoli.<br>\u00a7 9 Povinnosti ubytovatele<br>9.1 Ubytovatel je povinen poskytnout sjednan\u00e9 slu\u017eby v rozsahu odpov\u00eddaj\u00edc\u00edm jeho standardu.<br>9.2 P\u0159\u00edkladem zvl\u00e1\u0161tn\u00edch slu\u017eeb ubytovatele, kter\u00e9 podl\u00e9haj\u00ed ozna\u010den\u00ed a nejsou zahrnuty v cen\u011b ubytov\u00e1n\u00ed, jsou:<br>a) zvl\u00e1\u0161tn\u00ed slu\u017eby ubytov\u00e1n\u00ed, kter\u00e9 mohou b\u00fdt \u00fa\u010dtov\u00e1ny samostatn\u011b, jako je poskytnut\u00ed salonk\u016f, sauny, kryt\u00e9ho baz\u00e9nu, baz\u00e9nu, sol\u00e1ria, gar\u00e1\u017eov\u00e1n\u00ed atd.;<br>b) za poskytnut\u00ed p\u0159ist\u00fdlek, resp. d\u011btsk\u00fdch post\u00fdlek se \u00fa\u010dtuje sn\u00ed\u017een\u00e1 cena.<br>\u00a7 10 Haftung des Beherbergers f\u00fcr Sch\u00e4den an eingebrachten Sachen<br>10.1 Der Beherberger haftet gem\u00e4\u00df \u00a7\u00a7 970 ff ABGB f\u00fcr die vom Vertragspartner eingebrachten Sachen. Die Haftung des Beherbergers ist nur dann gegeben, wenn die Sachen dem Beherberger oder den vom Beherberger befugten Leuten \u00fcbergeben oder an einen von diesen angewiesenen oder hierzu bestimmten Ort gebracht worden sind. Sofern dem Beherberger der Beweis nicht gelingt, haftet der Beherberger f\u00fcr sein eigenes Verschulden oder das Verschulden seiner Leute sowie der aus- und eingehende Personen. Der Beherberger haftet gem\u00e4\u00df \u00a7 970 Abs 1 ABGB h\u00f6chstens bis zu dem im Bundesgesetz vom 16. November 1921 \u00fcber die Haftung der Gastwirte und anderer Unternehmer in der jeweils geltenden Fassung festgesetzten Betrag. Kommt der Vertragspartner oder der Gast der Aufforderung des Beherbergers, seine Sachen an einem besonderen Aufbewahrungsort zu hinterlegen nicht unverz\u00fcglich nach, ist der Beherberger aus jeglicher Haftung befreit. Die H\u00f6he einer allf\u00e4lligen Haftung des Beherbergers ist maximal mit der Haftpflichtversicherungssumme des jeweiligen Beherbergers begrenzt. Ein Verschulden des Vertragspartners oder Gastes ist zu ber\u00fccksichtigen.<br>10.2 F\u00fcr Kostbarkeiten, Geld und Wertpapiere haftet der Beherberger nur bis zum Betrag von derzeit \u20ac 550,\u2013. Der Beherberger haftet f\u00fcr einen dar\u00fcber hinausgehenden Schaden nur in dem Fall, dass er diese Sachen in Kenntnis ihrer Beschaffenheit zur Aufbewahrung \u00fcbernommen hat oder in dem Fall, dass der Schaden von ihm selbst oder einen seiner Leute verschuldet wurde. Die Haftungsbeschr\u00e4nkung gem\u00e4\u00df 12.1 und 12.2 gilt sinngem\u00e4\u00df.<br>F\u00fcr die von G\u00e4sten eigenst\u00e4ndig organisierten Aufbewahrung von Sachen und Gegenst\u00e4nde ((E-)Fahrr\u00e4der, SUP, Ski, Fahrradtr\u00e4ger, Kinderwagen usw.) in den von G\u00e4sten allgemein zug\u00e4nglichen Abstellr\u00e4ume wird keine Haftung \u00fcbernommen. <br>10.3 Die Verwahrung von Kostbarkeiten, Geld und Wertpapieren kann der Beherberger ablehnen, wenn es sich um wesentlich wertvollere Gegenst\u00e4nde handelt, als G\u00e4ste des betreffenden Beherbergungsbetriebes gew\u00f6hnlich in Verwahrung geben.<br>\u00a7 11 Haftungsbeschr\u00e4nkungen<br>11.1 Ist der Vertragspartner ein Unternehmer, wird die Haftung des Beherbergers f\u00fcr leichte und grobe Fahrl\u00e4ssigkeit ausgeschlossen. In diesem Fall tr\u00e4gt der Vertragspartner die Beweislast f\u00fcr das Vorliegen des Verschuldens. Folgesch\u00e4den, immaterielle Sch\u00e4den oder indirekte Sch\u00e4den sowie entgangene Gewinne werden nicht ersetzt.              \u0160koda, kter\u00e1 m\u00e1 b\u00fdt nahrazena, nach\u00e1z\u00ed v ka\u017ed\u00e9m p\u0159\u00edpad\u011b svou hranici ve v\u00fd\u0161i z\u00e1jmu na spln\u011bn\u00ed smlouvy.<br>\u00a7 12 Chov zv\u00ed\u0159at<br>12.1 V cel\u00e9m are\u00e1lu provozovny se nesm\u00ed zdr\u017eovat zv\u00ed\u0159ata.<br>\u00a7 13 Prodlou\u017een\u00ed ubytov\u00e1n\u00ed<br>13.1 Smluvn\u00ed partner nem\u00e1 n\u00e1rok na prodlou\u017een\u00ed sv\u00e9ho pobytu. Pokud smluvn\u00ed partner v\u010das ozn\u00e1m\u00ed sv\u00e9 p\u0159\u00e1n\u00ed prodlou\u017eit pobyt, m\u016f\u017ee ubytovatel s prodlou\u017een\u00edm smlouvy o ubytov\u00e1n\u00ed souhlasit. Ubytovateli z toho nevypl\u00fdv\u00e1 \u017e\u00e1dn\u00e1 povinnost.<br>13.2 Pokud smluvn\u00ed partner nem\u016f\u017ee v den odjezdu opustit ubytovac\u00ed za\u0159\u00edzen\u00ed, proto\u017ee v d\u016fsledku nep\u0159edv\u00eddateln\u00fdch mimo\u0159\u00e1dn\u00fdch okolnost\u00ed (nap\u0159. extr\u00e9mn\u00ed sn\u011b\u017een\u00ed, povodn\u011b atd.) jsou ve\u0161ker\u00e9 mo\u017enosti odjezdu uzav\u0159eny nebo<br>nepou\u017eiteln\u00e9, prodlu\u017euje se smlouva o ubytov\u00e1n\u00ed automaticky po dobu nemo\u017enosti odjezdu. Sn\u00ed\u017een\u00ed odm\u011bny za tuto dobu je p\u0159\u00edpadn\u011b mo\u017en\u00e9 pouze tehdy, pokud smluvn\u00ed partner nem\u016f\u017ee pln\u011b vyu\u017e\u00edvat nab\u00edzen\u00e9<br>slu\u017eby ubytovac\u00edho za\u0159\u00edzen\u00ed v d\u016fsledku mimo\u0159\u00e1dn\u00fdch pov\u011btrnostn\u00edch podm\u00ednek. Ubytovatel je opr\u00e1vn\u011bn po\u017eadovat alespo\u0148 takovou odm\u011bnu, kter\u00e1 odpov\u00edd\u00e1 obvykle \u00fa\u010dtovan\u00e9 cen\u011b v<br>mimosez\u00f3n\u011b.    <br>\u00a7 14 Ukon\u010den\u00ed smlouvy o ubytov\u00e1n\u00ed \u2013 p\u0159ed\u010dasn\u00e9 zru\u0161en\u00ed<br>14.1 Pokud byla smlouva o ubytov\u00e1n\u00ed uzav\u0159ena na dobu ur\u010ditou, kon\u010d\u00ed uplynut\u00edm \u010dasu.<br>14.2 Smrt\u00ed hosta kon\u010d\u00ed smlouva s ubytovatelem.<br>14.3 Pokud byla smlouva o ubytov\u00e1n\u00ed uzav\u0159ena na dobu neur\u010ditou, mohou smluvn\u00ed strany smlouvu vypov\u011bd\u011bt do 10:00 hodin t\u0159et\u00edho dne p\u0159ed zam\u00fd\u0161len\u00fdm koncem smlouvy.<br>14.4 Ubytovatel je opr\u00e1vn\u011bn vypov\u011bd\u011bt smlouvu o ubytov\u00e1n\u00ed s okam\u017eitou platnost\u00ed z d\u016fle\u017eit\u00e9ho d\u016fvodu, zejm\u00e9na pokud smluvn\u00ed partner, resp. host<br>a) u\u017e\u00edv\u00e1 prostory zna\u010dn\u011b nevhodn\u00fdm zp\u016fsobem nebo sv\u00fdm bezohledn\u00fdm, pohor\u0161uj\u00edc\u00edm nebo jinak hrub\u011b nevhodn\u00fdm chov\u00e1n\u00edm znep\u0159\u00edjem\u0148uje spole\u010dn\u00e9 sou\u017eit\u00ed ostatn\u00edm host\u016fm, majiteli, jeho lidem nebo t\u0159et\u00edm osob\u00e1m bydl\u00edc\u00edm v ubytovac\u00edm za\u0159\u00edzen\u00ed, nebo se v\u016f\u010di t\u011bmto osob\u00e1m dopust\u00ed trestn\u00e9ho \u010dinu proti majetku, mravnosti nebo t\u011blesn\u00e9 bezpe\u010dnosti;<br>b) onemocn\u00ed naka\u017elivou nemoc\u00ed nebo nemoc\u00ed, kter\u00e1 p\u0159esahuje dobu ubytov\u00e1n\u00ed, nebo se jinak stane osobou vy\u017eaduj\u00edc\u00ed p\u00e9\u010di;<br>c) nezaplat\u00ed p\u0159edlo\u017een\u00e9 faktury v dob\u011b splatnosti v p\u0159im\u011b\u0159en\u011b stanoven\u00e9 lh\u016ft\u011b (3 dny).<br>14.6 Pokud se pln\u011bn\u00ed smlouvy stane nemo\u017en\u00fdm v d\u016fsledku ud\u00e1losti, kterou lze pova\u017eovat za vy\u0161\u0161\u00ed moc<br>(nap\u0159. \u017eiveln\u00ed pohromy, st\u00e1vka, v\u00fdluka, \u00fa\u0159edn\u00ed na\u0159\u00edzen\u00ed atd.), m\u016f\u017ee ubytovatel smlouvu o ubytov\u00e1n\u00ed kdykoli vypov\u011bd\u011bt bez dodr\u017een\u00ed v\u00fdpov\u011bdn\u00ed lh\u016fty, pokud se smlouva ji\u017e nepova\u017euje za zaniklou podle<br>z\u00e1kona nebo pokud je ubytovatel zpro\u0161t\u011bn sv\u00e9 povinnosti ubytov\u00e1n\u00ed. Jak\u00e9koli n\u00e1roky na n\u00e1hradu \u0161kody atd. smluvn\u00edho partnera jsou vylou\u010deny.<br>\u00a7 15 Onemocn\u011bn\u00ed nebo \u00famrt\u00ed hosta<br>15.1 Pokud host b\u011bhem sv\u00e9ho pobytu v ubytovac\u00edm za\u0159\u00edzen\u00ed onemocn\u00ed, zajist\u00ed ubytovatel na p\u0159\u00e1n\u00ed hosta l\u00e9ka\u0159skou p\u00e9\u010di. P\u0159i nebezpe\u010d\u00ed z prodlen\u00ed zajist\u00ed ubytovatel l\u00e9ka\u0159skou p\u00e9\u010di i bez zvl\u00e1\u0161tn\u00edho p\u0159\u00e1n\u00ed hosta, zejm\u00e9na pokud je to nezbytn\u00e9 a host toho s\u00e1m nen\u00ed schopen.<br>15.2 Dokud host nen\u00ed schopen \u010dinit rozhodnut\u00ed nebo nelze kontaktovat p\u0159\u00edbuzn\u00e9 hosta, zajist\u00ed ubytovatel l\u00e9ka\u0159sk\u00e9 o\u0161et\u0159en\u00ed na n\u00e1klady hosta. Rozsah t\u011bchto opat\u0159en\u00ed v\u0161ak kon\u010d\u00ed v okam\u017eiku, kdy host m\u016f\u017ee \u010dinit rozhodnut\u00ed nebo kdy byli p\u0159\u00edbuzn\u00ed o onemocn\u011bn\u00ed informov\u00e1ni<br>.<br>15.3 Ubytovatel m\u00e1 v\u016f\u010di smluvn\u00edmu partnerovi a hostovi nebo v p\u0159\u00edpad\u011b \u00famrt\u00ed v\u016f\u010di jejich pr\u00e1vn\u00edm n\u00e1stupc\u016fm n\u00e1roky na n\u00e1hradu zejm\u00e9na n\u00e1sleduj\u00edc\u00edch n\u00e1klad\u016f:<br>a) neuhrazen\u00e9 n\u00e1klady na l\u00e9ka\u0159e, n\u00e1klady na p\u0159evoz nemocn\u00e9ho, l\u00e9ky a l\u00e9\u010debn\u00e9 pom\u016fcky,<br>b) nezbytn\u00e1 dezinfekce prostor,<br>c) nepou\u017eiteln\u00e9 pr\u00e1dlo, l\u016f\u017ekoviny a vybaven\u00ed l\u016f\u017eek, v opa\u010dn\u00e9m p\u0159\u00edpad\u011b za dezinfekci nebo d\u016fkladn\u00e9 vy\u010di\u0161t\u011bn\u00ed v\u0161ech t\u011bchto p\u0159edm\u011bt\u016f,<br>d) obnova st\u011bn, p\u0159edm\u011bt\u016f za\u0159\u00edzen\u00ed, koberc\u016f atd.,<br>pokud byly tyto v souvislosti s onemocn\u011bn\u00edm nebo \u00famrt\u00edm zne\u010di\u0161t\u011bny nebo po\u0161kozeny,<br>e) n\u00e1jemn\u00e9 za pokoj, pokud byl prostor hostem vyu\u017e\u00edv\u00e1n, plus p\u0159\u00edpadn\u00e9 dny nepou\u017eitelnosti prostor z d\u016fvodu dezinfekce, vyklizen\u00ed apod.,<br>f) p\u0159\u00edpadn\u00e9 dal\u0161\u00ed \u0161kody, kter\u00e9 ubytovateli vzniknou.    <br>\u00a7 16 M\u00edsto pln\u011bn\u00ed, soudn\u00ed p\u0159\u00edslu\u0161nost a volba pr\u00e1va<br>16.1 M\u00edstem pln\u011bn\u00ed je m\u00edsto, kde se nach\u00e1z\u00ed ubytovac\u00ed za\u0159\u00edzen\u00ed.<br>16.2 Tato smlouva podl\u00e9h\u00e1 rakousk\u00e9mu form\u00e1ln\u00edmu a materi\u00e1ln\u00edmu pr\u00e1vu s<br>vylou\u010den\u00edm pravidel mezin\u00e1rodn\u00edho pr\u00e1va soukrom\u00e9ho (zejm\u00e9na IPRG a EV\u00dc)<br>jako\u017e i \u00damluvy OSN o smlouv\u00e1ch o mezin\u00e1rodn\u00ed koupi zbo\u017e\u00ed.<br>16.3 V\u00fdlu\u010dn\u00fdm soudem pro dvoustrann\u00e9 obchodn\u00ed vztahy mezi podnikateli je s\u00eddlo ubytovatele, p\u0159i\u010dem\u017e ubytovatel je nav\u00edc opr\u00e1vn\u011bn uplat\u0148ovat sv\u00e1 pr\u00e1va tak\u00e9 u jak\u00e9hokoli jin\u00e9ho m\u00edstn\u011b a v\u011bcn\u011b p\u0159\u00edslu\u0161n\u00e9ho soudu.<br>16.4 Pokud byla smlouva o ubytov\u00e1n\u00ed uzav\u0159ena se smluvn\u00edm partnerem, kter\u00fd je spot\u0159ebitelem<br>a m\u00e1 sv\u00e9 bydli\u0161t\u011b, resp. obvykl\u00fd pobyt v Rakousku, mohou b\u00fdt \u017ealoby proti spot\u0159ebiteli pod\u00e1ny v\u00fdhradn\u011b v m\u00edst\u011b bydli\u0161t\u011b, obvykl\u00e9ho pobytu nebo v m\u00edst\u011b zam\u011bstn\u00e1n\u00ed spot\u0159ebitele.<br>16.5 Pokud byla smlouva o ubytov\u00e1n\u00ed uzav\u0159ena se smluvn\u00edm partnerem, kter\u00fd je spot\u0159ebitelem<br>a m\u00e1 sv\u00e9 bydli\u0161t\u011b v \u010dlensk\u00e9m st\u00e1t\u011b Evropsk\u00e9 unie (s v\u00fdjimkou Rakouska), na Islandu, v Norsku nebo ve \u0160v\u00fdcarsku, je v\u00fdhradn\u011b p\u0159\u00edslu\u0161n\u00fd soud, kter\u00fd je m\u00edstn\u011b a v\u011bcn\u011b p\u0159\u00edslu\u0161n\u00fd pro bydli\u0161t\u011b spot\u0159ebitele pro \u017ealoby proti spot\u0159ebiteli.<br>\u00a7 17 Ostatn\u00ed<br>17.1 Pokud v\u00fd\u0161e uveden\u00e1 ustanoven\u00ed nestanov\u00ed nic zvl\u00e1\u0161tn\u00edho, za\u010d\u00edn\u00e1 b\u011bh<br>lh\u016fty doru\u010den\u00edm p\u00edsemnosti na\u0159izuj\u00edc\u00ed lh\u016ftu smluvn\u00edm partner\u016fm, kte\u0159\u00ed maj\u00ed lh\u016ftu dodr\u017eet. P\u0159i v\u00fdpo\u010dtu lh\u016fty ur\u010den\u00e9 podle dn\u016f se nezapo\u010d\u00edt\u00e1v\u00e1 den, na kter\u00fd p\u0159ipad\u00e1 okam\u017eik nebo ud\u00e1lost, podle n\u00ed\u017e se m\u00e1 \u0159\u00eddit za\u010d\u00e1tek lh\u016fty.<br>Lh\u016fty ur\u010den\u00e9 podle t\u00fddn\u016f nebo m\u011bs\u00edc\u016f se vztahuj\u00ed k tomu dni v t\u00fddnu nebo m\u011bs\u00edci, kter\u00fd sv\u00fdm n\u00e1zvem nebo \u010d\u00edslem odpov\u00edd\u00e1 dni, od kter\u00e9ho se m\u00e1 lh\u016fta po\u010d\u00edtat. Pokud tento den v m\u011bs\u00edci chyb\u00ed, je v tomto m\u011bs\u00edci posledn\u00ed den<br>rozhoduj\u00edc\u00ed.<br>17.2 Prohl\u00e1\u0161en\u00ed mus\u00ed b\u00fdt druh\u00e9mu smluvn\u00edmu partnerovi doru\u010dena posledn\u00ed den lh\u016fty (24:00 hod.).<br>17.3 Ubytovatel je opr\u00e1vn\u011bn zapo\u010d\u00edst sv\u00e9 vlastn\u00ed pohled\u00e1vky proti pohled\u00e1vce smluvn\u00edho partnera.
